You may have heard about the hottest income craze that is sweeping the globe today and it's called Cash Gifting. Although it's been around for centuries; it has now become the most sought after, money making program according to Google Trends.
The law states, that one or more individuals can give a gift to another individual of up to $12,000 each, per calendar year, without any tax liability to either the giver or receiver of the gift, because the tax on the gift has already been paid. These gifts are not included in the gross income of the recipient.
Most people want to know if it's legal or not and how can they tell if a program is legit since they all claim they are? Although they all seem to be ethical programs on the outside, claim to follow the law, you have to think about this! Is it really legal for anyone to gift someone else according to the tax codes (Title 26, Sections 2501-2504 and 2511, and Canadian Tax Code: Sections 143.3 and 62.0), and can I also expect it's also legal to promote the same to others? Not at all! Why not?
If you were going to send someone a gift for whatever reason, would you also ask this same person to send you a gift in return? I think not! Now I'm no lawyer but here's how I read the law. Yes it's alright to send anyone you wish a gift, even cash; however if you also request that person to do the same, even if you are not implying they send you anything back in return, you are still soliciting others to follow you. This is considered a business transaction and it does not matter if a person signs a gifting disclaimer or a non-solicitation form, you are still petitioning that person and that's illegal!
Another problem! I am sure you've seen all over the internet, on those video community sites, people opening overnight envelopes, pulling out a magazine stuff full of cash, counting right in front of their camera hundreds of dollars to prove that their gifting program actually works! Well to be totally honest, they do work but here is the legal problem. Is it also legal to send cash in the mail by Federal Express, UPS or others? Not one bit! To prove this point, just read any of the carriers "Terms and Conditions" and tell me what you discovered?
For example; here's Federal Express's "Terms and Conditions" and it states; "Prohibited Items: You are prohibited from tendering the following items for shipment, and they will not be accepted: CASH, currency, collectible stamps and coins."
Why take a risk doing something illegal, getting caught or maybe even prosecuted? If you are already in a program like this, that uses these illegal techniques, get out and seek another who at least follows the law! Find one that sends and receives their cash the legal way by; debit card, merchant account or money order.
